NOTICE OF PRIVACY

PRIVACY NOTICE FOR CUSTOMERS AND PROSPECTS

In compliance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties and its Regulations, hereinafter LFPDPPP, we present this Privacy Notice under the following terms:

IDENTITY AND ADDRESS OF THE PERSON RESPONSIBLE FOR PERSONAL DATA

AUTOTRANSPORTES INTERNACIONALES, S.R.L. DE C.V., hereinafter THE RESPONSIBLE PARTY, declares to be a company legally constituted in accordance with Mexican laws and is responsible for the treatment and protection of your personal data and sensitive personal data, for the purposes indicated in this Privacy Notice. THE RESPONSIBLE PARTY can be contacted via the following email: ventas@ati.com.mx or at the address located at Nueva Santo Domingo 149, Col. Fracc. Ind. San Antonio, Azcapotzalco, Mexico City, Mexico, 02760.

In accordance with the provisions of the LFPDPPP, the terms used in this Privacy Notice will have the definitions assigned to them by the law, with the express exception of those defined herein. This Notice specifies the type of data THE RESPONSIBLE PARTY collects; the purposes for which it processes them, as well as the rights the owner has in this regard.

PRINCIPLES FOR THE PROCESSING OF PERSONAL DATA

THE RESPONSIBLE PARTY collects your personal data for the purposes mentioned in this Privacy Notice. In this context, we inform you that your personal data will be processed and safeguarded based on the principles of legality, quality, consent, information, purpose, loyalty, proportionality, and responsibility enshrined in the LFPDPPP.

PURPOSE AND USE OF PERSONAL DATA

We collect your personal data, which are processed in a strictly confidential manner and with the necessary physical and digital security measures to ensure their protection. Therefore, we request your consent through this Privacy Notice to use them for the following purposes:

  1. Primary Purposes:

  • Identify you as a customer, prospect, or user of our platform.

  • Contact you and send you relevant information about our services.

  • Provide local, national, or international moving services.

  • Evaluate the quality of the service we provide.

  • Provide the requested and/or contracted services.

  • Respond to your requests for information, assistance, and services.

  • Archive the records and files of the contractual relationship for future service follow-up.

  • Financial management, billing, and collection.

  • Fulfill and monitor the obligations and commitments we have made to you.

  • Your financial information may be provided to credit card issuers, financial institutions, or credit card processors to process transactions.

  • Notify and offer you new services according to your interests and needs.

2. Secondary Purposes: 

  • Contact and send newsletters, advertising, organized events, and promotions by THE RESPONSIBLE PARTY, affiliates, subsidiaries, or third parties who are our business partners.

  • To understand your consumption habits and preferences in order to personalize information about our products or services.

  • To create personalized ads for users who visited our website.

  • Conduct internal studies on consumption habits, marketing, advertising, and/or commercial prospecting purposes.

  • Statistical purposes, without personal data processing.

PERSONAL DATA

To efficiently provide our services and in accordance with the purposes mentioned above, we require your identification and contact information. Therefore, the personal data that THE RESPONSIBLE PARTY may collect through the means mentioned below are as follows:

  1. Identification: (name, date of birth, age, nationality, marital status, signature, CURP - Mexican tax ID).

  2. Contact: (address, location, origin and destination address, telephone numbers, email, social media).

  3. Financial Information: (tax information, billing address, Tax ID RFC - Registro Federal de Contribuyentes).

  4. Bank Accounts: (bank account number, Bank and CLABE, bank statements, credit or debit cards). 

 

The data mentioned in section number 3 will be used solely and exclusively for credit investigation with THE RESPONSIBLE PARTY.

SENSITIVE DATA

THE RESPONSIBLE PARTY does not store sensitive personal data such as racial or ethnic origin, current health status, genetic information, religious, philosophical, and moral beliefs, union membership, political opinions, or sexual preference under any circumstances.

ACCURACY OF USER-PROVIDED DATA

As a user or client, you guarantee that the personal data provided to THE RESPONSIBLE PARTY are true and you are responsible for informing us of any substantial changes to them at any time. Substantial changes will be understood as any alteration in the personal data that prevents proper contact, location, and subsequent identification of the user.

The personal data that THE RESPONSIBLE PARTY may collect, necessary to offer our services and products, or those derived or ancillary to them, physically, by telephone, through the Internet or any other electronic means, will be collected through the following methods:

TRANSFER OF PERSONAL DATA

THE RESPONSIBLE PARTY may share your personal data with controlling companies, subsidiaries, affiliates, or entities under common control of the responsible party, parent companies, or any company within the same group as the responsible party that operates under the same internal processes and policies, or related authorities for the management of your service. THE RESPONSIBLE PARTY will not exchange, share, publish, disclose, assign, or sell your personal data to third parties outside of THE RESPONSIBLE PARTY.

THE RESPONSIBLE PARTY may transfer your personal data without your prior consent only when it falls under the exceptions provided in Article 37 of the LFPDPPP, and in any case, complying with the conditions provided in Article 17 of the Regulations of the LFPDPPP. THE RESPONSIBLE PARTY undertakes to comply with and respect the legal principles of personal data protection when they are transferred, whether to individuals or legal entities, for the purpose of offering our products and services.

THE RESPONSIBLE PARTY will ensure, through the signing of agreements and/or adoption of other binding documents, that such third parties maintain appropriate security measures, administrative, technical, and physical, to safeguard your personal data, and that such third parties only use your personal data for the purposes for which they were hired and in accordance with this Privacy Notice.

MEANS TO PROTECT THE USE OR DISCLOSURE OF YOUR PERSONAL DATA

THE RESPONSIBLE PARTY will implement the necessary security measures, both technical and physical, to protect your personal data and prevent their damage, loss, alteration, destruction, or unauthorized use, access, or processing within the scope of this Privacy Notice. It ensures that only authorized personnel, who have complied with and observed the confidentiality requirements, may participate in the processing of your personal data. Authorized personnel are prohibited from allowing unauthorized access and using your personal data for purposes other than those established in this Privacy Notice. The confidentiality obligation of individuals involved in the processing of your personal data remains even after the relationship with THE RESPONSIBLE PARTY has ended.

MEANS TO EXERCISE YOUR ARCO RIGHTS AS THE DATA SUBJECT

As the data subject of the personal data covered by this Privacy Notice, you have the right to know what personal data we store, how we use them, and the conditions under which we use them. In this regard, you may exercise your Access, Rectification, Cancellation, or Opposition rights (ARCO Rights), as established in the LFPDPPP. Likewise, you may revoke, at any time, the consent you have granted and which is necessary for the processing and use of your personal data, provided that there is no current relationship or link with THE RESPONSIBLE PARTY.

If you wish to exercise your ARCO rights, you may do so at any time by directing your request to THE RESPONSIBLE PARTY through the following mechanism:

For this purpose, you must send us an email in which you inform us, accurately and in detail, about the specific personal data to which you wish to have access or that you require to be rectified, canceled, or opposed to their processing, as well as meet the following requirements:

  • The name of the data subject and address or other means to communicate the response to your request;

  • Documents proving the identity or, where appropriate, legal representation of the data subject;

  • A clear and precise description of the personal data for which one of the aforementioned rights is sought to be exercised.

  • Any other element or document that facilitates the location of the personal data.

THE RESPONSIBLE PARTY will contact you within a maximum period of twenty (20) days, counted from the date the access, cancellation, rectification, or opposition request was received, informing the respective decision. If deemed appropriate, the decision will be effective within a period of fifteen (15) days from the response received.

The cancellation of personal data will result in a blocking period after which THE RESPONSIBLE PARTY will proceed to delete the corresponding data. Once the corresponding personal data has been canceled, THE RESPONSIBLE PARTY will notify its owner. After this, THE RESPONSIBLE PARTY may retain the personal data exclusively for the purposes of the responsibilities arising from the processing referred to in this Privacy Notice. THE RESPONSIBLE PARTY is not obliged to cancel personal data in the cases set forth in Article 26 of the LFPDPPP. Likewise, when the information collected in the personal data is no longer necessary for the fulfillment of the purposes set forth in this Privacy Notice and in the applicable legal provisions, your personal data will be canceled from THE RESPONSIBLE PARTY's database.

REVOCATION AND/OR LIMITATION OF THE USE AND/OR DISCLOSURE OF YOUR PERSONAL DATA

Since the processing of your personal data is essential to provide our services, it is not possible to limit the data collection required by THE RESPONSIBLE PARTY. However, you may revoke or limit the use or disclosure of your personal data by sending your request to the email ventas@ati.com.mx.

If your request is granted, the use of the data will be revoked, and you will be included in THE RESPONSIBLE PARTY's exclusion list. It is important to inform you that we may not be able to immediately comply with your request or conclude the use, as there may be legal obligations or ongoing legal relationships at the time of your request that require us to continue processing your personal data. In this regard, we will address your request within a maximum period of twenty (20) days from the date the request was received, and we will inform you of the outcome.

INTERNATIONAL STANDARDS FOR THE PROTECTION OF PERSONAL DATA

To protect your personal data as effectively as possible, and considering that anyone from anywhere in the world can access the website and share their data with us, THE RESPONSIBLE PARTY has decided to implement some provisions of Regulation (EU) 2016/679, known as the General Data Protection Regulation of the European Union (GDPR). In this regard, in addition to the ARCO Rights, you have the following rights regarding your personal data:

  • Right to Portability: This right allows you to have your data transferred to a third party other than THE RESPONSIBLE PARTY if you wish.

  • Right to Information: In the event of a data breach, THE RESPONSIBLE PARTY will inform you about such breach within 3 days of becoming aware of it.

  • Right to Erasure: You may request the deletion of your data when, among other reasons, the data are no longer necessary for the purposes for which they were collected.

 

If you wish to exercise these rights, you may do so at any time by directing your request to THE RESPONSIBLE PARTY using the same ARCO Rights mechanism mentioned above. It is important to inform you that we may not be able to immediately comply with your request or conclude the use, as there may be legal obligations that require us to continue processing your personal data at the time of your request. In this regard, we will address your request within a maximum period of twenty (20) days from the date the request was received, and we will inform you of the outcome.

THE RESPONSIBLE PARTY will retain the personal data of users only for the time necessary to achieve the purposes for which they were collected, as long as the consents granted are not revoked. In this sense, personal data will be retained for the time that, in each case, is considered necessary to justify and/or be accountable regarding the management, which may be linked to legal prescription periods or the possibility of receiving requests from competent authorities.

THE RESPONSIBLE PARTY is authorized to process your personal data because you have given your consent for specific purposes, requested in order to provide our services. Regarding service reservations, payment, and billing, the processing is legitimized by the service reservation and billing request. The processing of data to send you emails about services, events, and news related to our professional activity is based on THE RESPONSIBLE PARTY's legitimate interest to carry out such processing in accordance with current regulations. Likewise, user information may be used to fulfill THE RESPONSIBLE PARTY's different legal obligations.

AUTOMATION OF DATA USE. SERVICE QUALITY.

Personal data will be subject to automated processing in accordance with THE RESPONSIBLE PARTY's policies, and it will be made available to users or clients so that they can access this privacy policy or any other important information. However, unless otherwise indicated, responses regarding some of the required personal data are voluntary, and the failure to respond to them does not imply a deterioration in the quality of the products or services offered.

The collection and automated processing of personal data aim to maintain the contractual relationship established, if applicable, under the terms and conditions that the user expressly accepts when making any transaction involving a product or service provided by THE RESPONSIBLE PARTY. THE RESPONSIBLE PARTY has the highest levels of security for protecting personal data required by current legislation and strives to adapt to legal and technological needs and requirements.

THE RESPONSIBLE PARTY has not reviewed the Privacy Notices of such websites, so it does not guarantee or assume responsibility for the content on those sites. MODIFICATIONS TO THE PRIVACY NOTICE

THE RESPONSIBLE PARTY reserves the right to amend or modify this Privacy Notice as it deems appropriate, for example, to comply with changes to legislation on personal data protection or to comply with internal provisions, such as new requirements for the provision and offering of our products, services, or practices within the market. THE RESPONSIBLE PARTY will make the updated Privacy Notice available to you when changes are made to it, as well as when your consent is required.

The updated version of the Privacy Notice will be available to the public through the following means:

  • On our website www.ati.com.mx in the Privacy Notice section.

  • Visible notification in our offices.

  • Sent to the last email address you provided to us.

This Privacy Notice is governed by the Federal Law on the Protection of Personal Data Held by Private Parties, its Regulations, and other applicable legal provisions in the United Mexican States.
